1. General provisions and services provided
1.1. These terms and conditions (the “Terms”) set out the
rules for the provision of short-term accommodation services at Nidos Namai
(Taikos g. 41, Neringa, Lithuania; “Nidos Namai”). The service provider (the
“Service Provider”) is UAB „Marių namai“ (company code 300133313, VAT code
LT100008581419, registered office Taikos g. 41, Neringa, Lithuania); email
info@nidosnamai.lt, tel. +370 686 11885.
1.2. The recipient of the services (the “Guest”) is the
person who books the accommodation. The Terms form an integral part of the
accommodation agreement. The Guest is responsible for ensuring that they are
observed by the persons arriving with the Guest and by everyone the Guest
invites onto the Nidos Namai grounds (the “visitors”).
1.3. The accommodation is intended for rest and holidays.
The premises (apartments or cottage) are handed over clean, with clean bed
linen and towels for each person named in the reservation, together with
furniture, household and sanitary equipment and other inventory (the
“Equipment”).
1.4. Nidos Namai does not provide catering. Cleaning, bed
linen and towel change, and parking services may be provided for an additional
fee, unless the reservation states otherwise.
2. Reservation and conclusion of the agreement
2.1. All orders are placed in the online shop
www.nidosnamai.lt (the “Website”). The Guest selects the dates, premises and
number of persons, reviews the price and these Terms, and by clicking the
“Order” button confirms that they agree to them.
2.2. When making a reservation, the Guest provides: the
number of persons arriving (adults, teenagers and children separately), their
names and surnames, the children's ages, the desired type of premises, the
arrival and departure dates, the payment method and any other requests.
2.3. The final price and payment terms (the advance and the
deadline for the balance) are shown on the Website when the order is placed.
After placing the order, the Guest receives its confirmation at the email
address provided.
2.4. The reservation is guaranteed and the accommodation
agreement is considered concluded when the Guest pays the advance within the
time period specified in the Terms. If the advance is not paid on time, the
reservation is cancelled automatically without any consequences for the Guest.
3. Prices and payment
3.1. Prices are stated in euros including VAT on the Website
when the order is placed. The price depends on the dates, type of premises,
number of persons and the selected rate. Discounts (e.g. for a longer stay)
apply in accordance with the conditions stated on the Website.
3.2. The price does not include a parking space, additional
cleaning, change of bed linen and towels during the stay, or local fees, if
applicable. These services are ordered separately.
3.3. The confirmed price is not changed. Exceptions: a
change in tax legislation or an obvious typing error (in which case the Guest
may cancel the reservation free of charge).
3.4. Payment procedure (unless otherwise agreed):
•
Advance: at
least 20% of the price is paid within the set time after the reservation is
confirmed, but no later than 30 days before the start of the stay.
•
Balance:
paid no later than 30 days before the start of the stay.
•
Booking less
than 30 days before the stay: the full price is paid within the set time
after confirmation.
3.5. If the advance or the price is not paid on time, the
reservation is cancelled. If the Guest does not pay the balance by the
deadline, the Service Provider may cancel the reservation by notifying the
Guest at least 3 days in advance; the cancellation conditions apply (Section
4).
3.6. Payment can be made by card, through payment systems or
by bank transfer. For bank transfers, use the following details: recipient UAB
„Marių namai“, account LT244010051003425228, Luminor Bank AB. In the payment
reference, state the Guest's name, surname and the period of stay. A transfer
is considered paid from the moment it is credited to the recipient's account.
4. Cancellation, changes and no-show
4.1. A reservation can be cancelled in the booking system or
by email at info@nidosnamai.lt; the date of cancellation is the date the notice
is received.
4.2. If the reservation is cancelled:
|

|

|
|

|

|
|

|
100% of the price
|
4.3. A Guest who departs earlier than the end of the
accommodation period is not refunded for unused nights, unless the parties
agree otherwise.
4.4. Changes to the reservation dates or premises are
possible with the Service Provider's consent, if premises are available.
Otherwise the change is treated as a cancellation of the reservation and a new
reservation, and the conditions of clause 4.2 apply to the original
reservation.
4.5. Where accommodation is booked for a specific date,
there is no right of withdrawal within 14 days after the conclusion of a
distance contract (Law on Consumer Rights Protection of the Republic of
Lithuania); the cancellation conditions are set out in this Section.
4.6. If the Service Provider is unable to provide the
accommodation due to circumstances beyond its control, it will inform the Guest
without delay and refund all amounts paid or offer an equivalent alternative.
5. Arrival and departure
5.1. The accommodation begins at 16:00 on the day of arrival
and ends at 11:00 on the day of departure. If the Guest does not arrive by
23:59 without having agreed the arrival time, the Service Provider may
accommodate other guests; in that case the Guest is considered a no-show
(Section 4).
5.2. The registration form (names, place of residence,
identity document details, arrival and departure dates, etc.) must be completed
electronically no later than 24 hours before arrival. If the Guest wishes to
complete the registration form on arrival, an additional fee of €20 per
apartment (cottage) applies.
5.3. No security deposit is required. The Guest is liable
for any damage caused in accordance with Section 7.
5.4. The premises are handed over in good order and without
defects. The Guest must report any deficiencies or defects noticed within 4
hours of arrival; any that become apparent during the stay must be reported
immediately.
5.5. The doors of the premises are opened with electronic
locks. The access code is valid until the departure time (11:00), so there are
no keys or codes to return. The Guest vacates the premises by 11:00 on the day
of departure. If a lock is broken or otherwise irreparably damaged, the minimum
damage is €400. The Service Provider may change the arrival and departure
times.
5.6. If the premises are not vacated by 11:00, the Service
Provider may charge €50 for each hour (or part of an hour) of delay; if they
are not vacated by 16:00, an additional day is charged at the applicable rate
(100% of the daily price), without prejudice to the right to evict the
visitors.
6. House rules of Nidos Namai
6.1. The premises may be used only for rest and holidays.
The premises may not be handed over to third parties.
6.2. The following is prohibited:
•
accommodating persons not named in the reservation and
registration form; exceeding the stated number of guests.
•
smoking in the premises and on the grounds, except in
designated marked areas. In case of violation, €200 is payable (minimum
damages);
•
bringing in an animal or bird without the Service
Provider's prior consent. In case of violation, €100 is payable (minimum
damages);
•
bringing into or storing in the premises bicycles,
scooters and other outdoor vehicles;
•
wearing dirty, mark-leaving footwear or high heels that
may damage the floors inside the premises;
•
setting off fireworks or lighting bonfires without
prior agreement;
•
playing outdoor games (football, badminton, etc.) in
areas not designated for them;
•
taking white towels, bed linen or other items found in
the premises out of the grounds;
•
drying towels or items on balcony railings or in other
places not designated for it;
•
leaving children unattended and leaning out of windows
or balconies;
•
bringing and playing musical instruments without prior
agreement; playing music or making noise in a way that disturbs others;
•
littering, damaging or destroying property;
•
being under the influence of alcohol or other
psychotropic substances, or keeping narcotic or other prohibited substances, or
dangerous, explosive or radioactive items.
6.3. Quiet hours: from 20:00 to 08:00, it is prohibited to
make noise, shout, sing loudly or play music.
6.4. A parking space is provided if it is included in the
reservation or ordered additionally. The vehicle must be roadworthy, parked
properly and not obstruct others; otherwise the Service Provider may call a tow
truck, and the Guest bears the towing and storage costs.
6.5. Any found or lost items must be reported to the Service
Provider immediately. At the Guest's request, items are sent at the Guest's
expense.
6.6. The Guest must comply with fire-safety, safety,
sanitary and environmental requirements, use electrical and other appliances
safely in accordance with the instructions and, if unsure how to use an
appliance, ask the Service Provider. Wet floors (especially tiles) are slippery
and the stairs are steep, so children must be supervised.
7. Liability, damage, penalties
7.1. The Guest compensates for damage caused to the
premises, the Equipment and other property if it was caused by the Guest, the
persons arriving with the Guest or persons invited by the Guest. Damage must be
reported immediately. The Service Provider assesses the damage and states its
amount; it is to be compensated by departure or within 3 working days of the
assessment being provided.
7.2. The penalties stated in the Terms (smoking – €200,
animals – €100, damage to a lock – €400, late departure – Section 5) are
considered minimum losses. If the actual damage is greater, the Guest
compensates the difference.
7.3. The Service Provider is not liable for the property of
the Guest and visitors, its safekeeping or loss, or for damage resulting from
failures or interruptions of electricity, water supply, heating or other
systems, except where caused by improper maintenance by the Service Provider.
The Service Provider does not provide storage services; there is no safe in the
premises.
7.4. The Service Provider or its representative may inspect
the premises after giving the Guest advance notice. Entry without notice is
permitted only in cases of emergency or to limit damage.
7.5. The Service Provider is not liable for noisy or
inappropriate behaviour of other persons on the grounds; the Guest must inform
the Service Provider of such behaviour.
7.6. If there is a suspicion that the Guest or visitors are
violating public order or committing offences, the Service Provider may contact
the police without warning.
7.7. The parties are not liable for failure to perform the
Terms if it is caused by force majeure circumstances that the parties could not
foresee and avoid.
8. End and termination of the agreement
8.1. The agreement ends when the accommodation period ends.
8.2. The Service Provider may terminate the agreement before
the end of the term:
•
after a warning (oral or written), if the Guest does
not immediately remedy the violation: uses the premises contrary to the Terms,
worsens their condition or violates the house rules;
•
without warning, if the premises are used for a purpose
other than intended, or the prohibitions of clause 6.2 regarding the number of
guests, animals, damage to property, dangerous or narcotic substances and
intoxication are violated.
In that case the Guest must leave the premises immediately
and the price paid is not refunded.
8.3. The Guest may terminate the agreement before the end of
the term if the premises have become unfit for use due to circumstances beyond
the Guest's control; in that case the price for unused nights is refunded.
8.4. Upon expiry or termination of the agreement, the Guest
leaves the premises tidy and clean, with the Equipment and items, and pays all
outstanding amounts.
9. Personal data
9.1. The data controller is the Service Provider (clause
1.1). The following data are processed: name, surname, personal identification
number and document details (for registration), address, telephone number,
email, children's ages, car registration number (if arriving by car).
9.2. Data are processed for the conclusion and performance
of the agreement, for legal obligations (e.g. accommodation records) and
legitimate interests (security, accounting). With separate consent, they may
also be processed for other purposes.
9.3. Data may be processed by IT and accounting service
providers (reservation systems, accounting) on the instructions of the Service
Provider.
9.4. A person has the right to access their data, to request
that it be rectified, erased or its processing restricted, to receive their
data in a portable format, and to withdraw consent at any time. Requests can be
sent by email to info@nidosnamai.lt. Complaints about data processing may be
lodged with the State Data Protection Inspectorate; we invite you to contact us
first.
9.5. Data from performance of the agreement is retained for
10 years after the end of the agreement (the retention period for accounting
documents); data processed on the basis of consent is retained until consent is
withdrawn. After the period expires, the data is destroyed within a reasonable
time.
10. Complaints, disputes and final provisions
10.1. Claims and complaints can be sent by email to
info@nidosnamai.lt. The Service Provider responds within 14 days of receipt.
10.2. Consumer disputes are resolved out of court by the
State Consumer Rights Protection Authority (www.vvtat.lt).
10.3. Amendments to the Terms take effect from their
publication on the Website and apply to new reservations; confirmed
reservations are subject to the Terms in force at the time of booking.
10.4. The Terms and the agreement are governed by the law of
the Republic of Lithuania. Disputes are first resolved by negotiation, and
failing that, in the competent court of the Republic of Lithuania.
